1. Acceptance of Terms and Conditions

The Gidday.com service and the Gidday.com web site (referred to hereafter as 'the Gidday.com Network or ‘the Network’) is owned and operated by Gidday.com - ABN BN97808329 (referred to hereafter as 'Gidday.com'). Membership is free, and those who register to become members may be referred to as either ‘Members’ or ‘Registered Supporters’ – both terms have the same meaning for the purposes of this document.

As a free site that operates globally, Gidday.com is open for membership to people from all countries and of all ages. Membership of the Service is conditional upon acceptance of and compliance with the terms, conditions, notices and disclaimers contained in this document and elsewhere on the Gidday.com Network (referred to hereafter collectively as 'Terms and Conditions'). The submission of the online membership application constitutes the registered supporter's acceptance of the Terms and Conditions. Since the registered supporter is bound by these Terms and Conditions, they should periodically refer to them here. Gidday.com reserves the right to vary the Terms and Conditions, specifications, rules, and terms and conditions of any element of the Gidday.com Service and Network facilities at any time without notice. 

2. Membership

Continuation of a registered supporter’s Gidday.com membership is strictly conditional on the following:

  • Each email address can only belong to one registered supporter.
  • The registered supporter must not send unsolicited email ('SPAM') to strangers to promote Gidday.com.
  • An individual must not join nor use the Service on behalf of another individual.
  • The registered supporter must inform Gidday.com of any change in their email address.
  • Any other reason deemed inappropriate in the reasonable opinion of Gidday.com.
Gidday.com reserves the right to terminate the membership of individuals who fail to comply with any of these conditions of membership. Gidday.com also reserves the right to terminate the membership of any individual without cause or reason.

Individuals may use the Gidday.com site without becoming a registered supporter.

3. Newsletter

By joining the Gidday.com Service, registered supporters are entitled to elect to receive a regular newsletter via email. The newsletter’s main purpose is to outline what charitable or humanitarian works are being achieved by use of the funds generated by Gidday.com. The newsletter may contain some advertising, but it is not intended primarily as a commercial publication.

Registered supporters may choose not to receive a newsletter.

Those who do not register are unable to receive a newsletter as we do not have a record of their email address. 

4. Disclaimer of Warranty

The registered supporter acknowledges and accepts that Gidday.com makes no warranty or representation as to:

  • the accuracy, reliability or otherwise of any information obtained through membership of the service;
  • the service or network being uninterrupted, timely or error free;
  • the goods and/or services purchased or obtained through the service or network, including goods and or services offered by third party advertisers, except where expressly indicated. 

5. Limitation of Liability

The registered supporter releases Gidday.com and its officers, employees, agents, subsidiaries and affiliates from any claim for loss, damage or liability, including special indirect or consequential loss, in respect of:
  • any emails forwarded to the registered supporter;
  • membership of the service;
  • the registered supporter's use of or inability to use the Gidday.com Network;
  • the quality of goods and/or services purchased by the registered supporter;
  • any dispute with a supplier of goods and/or services.

6. Indemnification

The registered supporter indemnifies and keeps indemnified Gidday.com and its officers, employees, agents, subsidiaries and affiliates against all claims (including third party claims), demands, damages, costs (including legal costs), penalties or suits arising out of, or consequential upon, the registered supporter's use of the service. 

7. Termination

These Terms and Conditions are effective until terminated by Gidday.com.

Gidday.com may terminate these Terms and Conditions at any time without notice. 

8. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State of New South Wales and of the Commonwealth of Australia. The registered supporter submits to the jurisdiction of the courts of New South Wales and the Commonwealth of Australia.
